The Montreal Convention is an international treaty agreed by 140 states in respect of governing carriers’ liability for injury or death of passengers, damage to or loss of baggage and cargo and losses caused by delays. Hong Kong has adopted it through the Carriage by Air Ordinance (Cap 500).

According to Article 24 of the Montreal Convention, the limits of carriers’ liability in respect of the carriage of passengers, baggage and cargo as stated in the Montreal Convention are reviewed by the International Civil Aviation Organization (ICAO) every five years. If an inflation factor exceeds 10 per cent, the carriers’ liability limits will be revised.

The ICAO’s latest review has concluded that the inflation factor is 17.9 per cent and the limits of carriers’ liability are to be revised with effect from 28 December 2024.

The carriers’ limit of liability in case of destruction, loss, damage or delay in relation to the carriage of cargo is increased from 22 SDRs per kilogram to 26 SDRs per kilogram.

To ensure your limitation of liability under your Air Waybills is legally valid, we suggest you revise your Air Waybill contract terms so as to limit your liability to 26 SDRs per kilogram of the gross weight of the goods in respect of cargo loss, damage or delay.
